Last week marked the start of a new era of fresh air in New Jersey, as the recently-signed Smoke-Free Air Act came into force.

The new legislation stipulates that it is forbidden to smoke in public places, including bars and restaurants. Violators of the law caught smoking in public venues, as well as the establishments that allow them to do so can expect to be fined between $250 and $1000.

However, the new legislation does not apply to cigar bars, tobacco shops and casinos, meaning that the state is yet to legislate for smoke free gambling. Most casinos in New Jersey offer sectioned off designated smoke free gambling areas for non-smoking patrons, however the main gaming floors still permit smoking.

Increasing numbers of casino workers are complaining of chronic illnesses caused by being constantly exposed to passive smoke, such as asthma and other breathing problems.

Casino operators still express concerns that making their establishments smoke-free gambling environments could damage their profits, but the evidence from several states that already enforce smoke-free gambling in casinos shows that the legislation for the smoking ban has had no negative effect on casino revenues.

Studies into the effects of the smoking ban laws initiated in states including Massachusetts, Florida, and Texas showed that there was no reduction in business after the smoking bans were introduced, while in California and New York City, business actually grew immediately following the smoking bans.

The good news for New Jersey's smoke-free gambling lobbyists and casino workers is that most states introduced smoking bans gradually, meaning that a blanket ban on public smoking, including enforcing smoke-free gambling in casinos could be just around the corner.
